Terms of Service

1. Agreement to Terms

By accessing or using Obsidian Palace MCP Server ("Palace", "the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.

2. License Types

2.1 AGPL-3.0 License (Free)

Palace is released under the GNU Affero General Public License version 3.0 (AGPL-3.0). Under this license, you may:

  • Use the Software for any purpose
  • Study and modify the source code
  • Distribute copies of the Software
  • Distribute your modifications

However, if you modify the Software and offer it as a network service (SaaS), you must make your modified source code available to users of that service under AGPL-3.0.

2.2 Commercial License

Commercial licenses are available for users who wish to use Palace in proprietary software without the AGPL-3.0 copyleft requirements. Commercial license terms are detailed in: LICENSE-COMMERCIAL.md

3. Purchases and Payments

3.1 Payment Processing

All payments are processed by Paddle, who acts as our Merchant of Record. By making a purchase, you also agree to Paddle's terms of service.

3.2 Pricing

Prices are listed on our Pricing page and may change at any time. Price changes do not affect existing licenses.

3.3 Taxes

Paddle handles all applicable taxes (VAT, GST, sales tax) based on your location. The price shown at checkout includes any applicable taxes.

4. Refund Policy

We offer a 14-day no-questions-asked refund policy on all commercial license purchases.

  • Request a refund within 14 days of purchase
  • Email adamc@probablycomputers.com with your order number
  • Refunds are processed within 5-10 business days
  • Upon refund, your commercial license is revoked

5. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that:

  • The Software will meet your specific requirements
  • The Software will be uninterrupted, timely, secure, or error-free
  • The results from using the Software will be accurate or reliable
  • Any errors in the Software will be corrected

6. Limitation of Liability

IN NO EVENT SHALL PROBABLY COMPUTERS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Software
  • Any conduct or content of any third party
  • Unauthorized access, use, or alteration of your data

Our total liability for any claims under these terms shall not exceed the amount you paid us for the Software in the twelve (12) months prior to the claim.

7. Your Responsibilities

You are responsible for:

  • Maintaining backups of your Obsidian vault data
  • Ensuring your use complies with applicable laws
  • Keeping your license keys confidential
  • Not using the Software for any unlawful purpose

8. Support

Support levels vary by license type:

  • AGPL-3.0 (Free): Community support via GitHub Issues
  • Personal Pro: Email support
  • Commercial: Priority email support

We aim to respond to support requests within 5 business days for paid licenses.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes via our GitHub repository. Your continued use of the Software after changes constitutes acceptance of the new terms.

10. Governing Law

These terms are governed by the laws of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

11. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
